A state lawyer in a case in which Forum for Democratic Change presidential candidate Kizza Besigye is seeking his release on bail Monday found it hard trying to block the bail application.
The state attorney Florence Akello was seen wiping away sweat as it rolled down her face and cheek when she was laboring to make her submissions to counter Dr Besigye’s lawyer’s submissions to have him released from Luzira Prison where he’s being held so that he can attend court while coming from his Kasangati, Wakiso based home.
In her submission, Akello objected to Dr Besigye’s release on bail he is an influential leader in the community who has a large following and if freed, he will disrupt peace especially in Kampala city which might also lead to death of some of those followers.
She further argued that since the four time challenger of president Yoweri Museveni is facing grave charges of treason that attract a death penalty upon conviction, he has to present to court exceptional circumstances to convince court before he can be released on bail and that he had not done so.
The state also tried to punch holes in the submission of Dr Besigye in which he claimed to be of advanced age.
Ms Akello contended that Dr Besigye did not present any documentation like birth certificate to prove his age.
This was after Besigye’s lawyers led by Ernest Kalibala told court the FDC leader is 60 years old and could not survive prison conditions given his advanced age.
