Nakawa Division legislator Michael Kabaziguruka has run to High Court Civil Division in Kampala to his trial at the Makindye based military court.
In his petitioned, the jailed MP is seeking an order to halt his on-going trial before the General Court Martial.
Through his lawyers Rwakafuzi and company Advocates, Kabaziguruka challenges this trial on grounds that his right to a free and fair trial will be curtailed as the General Court Martial is not legally mandated to try civilians.
To support his claim in court, the legislator in his sworn affidavit stated that the President is telling the public through press conferences that he (Kabaziguruka) wanted to kill him something that the MP says is intended to clearly influence the outcome of his trial yet the president is immune to contempt of court proceedings.
On June 28, 23 people, including Kabaziguruka and UPDF officers were remanded over alleged plot to overthrow President Yoweri Museveni’s government.
They were charged before Makindye based General Court Martial on allegations of treachery and offences relating to security, which attract a maximum sentence of death upon conviction.
