Presidential hopeful, Amama Mbabazi, has written to the Electoral Commission seeking an explanation as to how it reached the decision of nominating president Yoweri Museveni as a presidential candidate.
The letter sent to EC is signed by Mbabazi’s lawyers led by Fred Muwema and Severino Twinobusingye.
According to Muwema, NRM has not yet elected its presidential flag bearer for the 2016 general elections in a delegates conference.
According to the road map released by deputy secretary general, Richard Todwong and NRM EC boss, Tanga Odoi, Museveni will be nominated on November 3, 2015 at Namboole stadium.
Yet, EC has already allowed Museveni a certificate confirming him as a presidential candidate.
Muwema says if EC goes out of its way and nominates the ruling party candidate, it will be a flawed process because the president has not been elected as the NRM flag bearer.
“If need be, let the EC engage us, we sit together and share and consult on the law,” the lawyer told NTV.
Muwema also faulted the EC for allowing NRM to pick the nomination for their candidate and return them “illegally”.
He said the EC was playing to the tune of the ruling party.
Muwema also wondered why EC pushed nomination dates from October to November which he says was done outside the law.
He gave EC an ultimatum of seven days to nullify President Museveni’s nomination.
“…if not, we shall proceed with legal action,” Muwema threatened.
He said on November 12, 2015 High Court in Kampala will hear a petition in which Mbabazi accuses the EC of being partisan and subjecting candidates to violence.
EC rubbishes the letter
EC spokesperson, Jotham Taremwa, confirmed receiving the letter but said Muwema and his colleague Severino were suffering from “lack of what to do”.
“They seem to be running out of any other business other than the electoral commission work,” Taremwa lashed out.
“I think they are trying to justify why they should be retained on a monthly basis to get money from their client. Otherwise, they are wasting the commission’s time, we have a lot of work to do.”
Taremwa said they don’t have time to keep reading letters from Muwema.
“This is diversionary. We have work to do. The commission has work to do. These are mind games.”
He continued: “Let me educate the Muwemas and Severinos. A road map is not casting stone. We are the ones who did this roadmap, you can always adjust when there is need.”
NRM EC chairperson, Dr Tanga Odoi, and NRM lawyer, Kiryowa Kiwanuka, say there is no need for choosing a flag bearer because Museveni is already unopposed in the ruling party.
“Whether there is a delegates conference or not, he is unopposed. In that conference, we will put ballot papers and ask delegates who they want as a candidate and we will have voted,” Tanga said.
To Kiryowa, Mbabazi’s lawyers are “flogging a dead horse” in their “ridiculous” pursuit.
“How can you ask EC to cancel a nomination that has not happened? It will happen in November. To write to EC now to cancel the nomination, I think is ridiculous,” Kiryowa said.
