The High Court in Kampala has sentenced to death a 40-year-old man who defiled and infected his daughter with HIV/AIDS.
High Court Judge Elizabeth Kibula Kabanda handed Denis Ssebugwaawo a death sentence after finding him guilty of the offence of aggravated defilement.
Prosecution proved that on January 21, 2013 at Kinaawa Village in Wakiso district Ssebugwaawo performed a sexual act on his daughter aged 12years and at the time of the offence he was HIV/AIDS.
“I am convinced that the prosecution has proved every ingredient of the offence of aggravated defilement to the required beyond reasonable doubt standard. Looking at the evidence of the medical examination of the victim together with the convict’s plain denial that he did not know the victim was defiled; I take it that his defense is utter lies. The action that was performed on the young girl was premeditated and the convict has never been remorseful to what he did,” the judge ruled.
The judge also noted that when Ssbugwaawa threatened to cut the victim incase she told anyone was not a conduct of an innocent man.
According to the facts court heard that during the month of January 2013, Ssebugwaawo escorted away his family members and returned with the victim on the same day.
On the fateful night, both victim and convict stayed in the house together.
She was noticed by a neighbor the next day walking while widening her legs and upon interrogation; she revealed that Ssebugwaawo had slept on her.
Ssebugwaawo was arrested from the same house he had committed the crime and taken into detention at Natete Police Station where he admitted being the biological father of the victim.
The victim was in a psychological condition attributable to sexual abuse by her father where she felt that everyone was against her something that forced her to escape from her relative in Kyotera district and at the time of trial, her whereabouts have remained unknown to the prosecution.
