Peter Ssematimba, the newly elected member of parliament for Busiro South constituency has told Court of appeal that the High Court judge Lydia Mugambe was wrong to throw him out of parliament.
In his appeal notice filed yesterday, Ssematimba claims the judge errered in law and facts when she ordered that his election be nulified because he did not have adequate academic papers to contest for the MP seat.
Justice Mugambe last Friday nullified Sematimba’s election on grounds that the National Council for Higher Education (NCHE) did not verify his academic papers.
This followed a petition filed by Democratic Party’s Stephen Ssekigozi, who contested against Mr Ssematimba of the ruling National Resistance Movement (NRM) for the Busiro South parliamentary seat and lost.
In his notice of intention to appeal, Sematimba said he will prove that he had all the required papers obtained from a US university but NCHE just delayed to verify them.
