Bukoto South MP Muhammad Muyanja Mbabaali could join the string of ruling party legislators who have been ejected from parliament over academic qualifications and vote rigging, among other reasons.
The High Court in Masaka accepted to hear an election petition that seeks to challenge the academic qualifications of Mbabaali who contested on the NRM ticket and defeated Democratic Party secretary general Mathias Nsubuga.
Gertrude Nakabira, a former Lwengo District Woman MP, who also contested against Mbabaali, petitioned court challenging his nomination on account that he lacked the required academic qualifications to contest as Member of Parliament.
She alleges that the mature age entry certificate from Makerere University and an Ordinary Level certificate which Mbabaali is said to have presented to EC are not genuine documents and need to be scrutinised.
According to Daily Monitor, in November last year, Nakabira applied to Masaka High Court, seeking to block Mbabaali’s nomination by the Electoral Commission (EC), but the hearing was stayed after the presiding judge John Eudes Keitirima, adjourned the case to February 15 this year.
Justice Keitirima last month dismissed the application on account that it had been overtaken by events because Mbabali had already been elected.
Nakabira’s lawyer Asuman Basalirwa filed a fresh application asking court to allow her file a petition challenging Mbabali’s election on academic grounds.
High Court Judge Margaret Tibulya on Thursday granted Nakabira two weeks to allow her file the petition.
