Hearing of Nakawa MP Michael Kabaziguruka’s bail application has failed to take off after prosecution maintained not to proceed.
His lawyer Ladslaus Rwakafuzi asked for an adjournment of one week to enable him serve the prosecution department of the General Court Martial, Director of Public of Prosecution (DPP) and Attorney General (AG) to choose among themselves on who to take up the matter.
This was after the DPP declined to proceed with the case on grounds that it a military court case.
According to prosecution led by Isaiah Wanamama, Article 123 of the Constitution does not allow DPP to proceed with matters before the army court.
Efforts by Kabaziguruka lawyer to have court proceed with the hearing bore no fruits.
Rwakafuzi had told court that the case is triable and therefore they were ready to proceed even without the DPP.
