The Constitutional Court in Kampala has referred Lwemiyaga County MP Theodore Ssekikubo’s case back to Masaka Chief Magistrates Court.
Ssekikubo was challenging a decision by Masaka Grade One Magistrate Samuel Manobe to order a vote recount for the February parliamentary elections.
This was after Patrick Nkalubo, Ssekikubo’s rival sought a vote recount saying the election was rigged.
Ssekikubo’s lawyers Caleb Alaka and Medard Sseggona run to the Constitutional Court challenging the ruling.
A panel of 5 judges led by Justice Richard Butera ruled on Wednesday that there nothing to interpret in the case by the constitutional court.
They three the case back at the Masaka magistrate to handle as he sees fit.
