Court dismisses case against Museveni old age


High Court judge Justice Stephen Musota has dismissed a suit against President Yoweri Museveni because of advanced age.

Opposition youth Moses Bigirwa, Hakim Kiiza and Musa Lusembo filed an application on Monday at the civil division of High Court in Kampala seeking an injunction to block Museveni from swearing in saying he was beyond the constitutional 75 years of age.

According to the trio, Museveni is now 79 years old.

The same group in 2012 held a parallel birthday party for Museveni saying he was 70 years old when the president was actually celebrating his 68th birthday.

In their application, the petitioners said that Museveni took part on general elections of 1961 as a voter [he voted for DP‘s Ben Kiwanuka], he was 23 years old.

He then spent 5 years in the bush and captured power when he was 48 years old.

He has since ruled for 31 years totalling to 79 years.

However, Justice Musota informed the petitioners that presidential elections petition were to be filed in the Supreme Court and they have already missed the deadline.

He also informed them that the president could not be dragged to court to defend himself, unless it was Supreme Court.

He concluded that the case lacked merit and dismissed it with costs.
