The High Court in Gulu has evicted the Member of Parliament for the newly created Aruu county North Constituency in Pader district Lucy Achiro Atim over noncompliance with the established electoral laws.
The presiding judge David Matuvo in his Tuesday morning verdict stated that because of the electoral commission’s unwillingness to comply with the electoral laws, the results were substantially affected.
Justice Matuvo ascertained that other irregularities like destruction of voting materials made it impossible to order for a recount for the Aruu County north.
The learned Judge ordered the Electoral commission to meet half of the suit cost Mr Kidega met in filling the petition.
Court also exonerated Aciro for election malpractice.
The petitioner James Kigeda Nabison who was a national resistance movement flag bearer through his lawyer Ladwar,Oneka and company advocates dragged Achiro Lucy Otim an independent candidate to court accusing her and the electoral commission for conniving to disenfranchise his victory.
One of the counsel who represented Kidega,Jude Ogik says they have happily welcomed the court’s verdict but that court should have ordered Achiro to meet the cost of the suit also.
Meanwhile Aciro Lucy Otim’s lead counsel Samuel Odonga Otoo disagreed with the ruling adding that he was surprised
In the February 18th election, Lucy Aciro narrowly defeated Kidega with a margin of only two votes to clinch the victory.
